Terms of Service
GABFORGE UNLIMITED. Hosted at gabforge.ai/legal/terms.
1. At a glance
| Question | Answer |
|---|---|
| Who can use this? | Anyone 18 or older in a country where we operate. |
| Do I own what I create? | Yes. Your chats, personas, documents, and subsite content are yours. We get only the licence we need to operate the service. |
| Can I trust the AI's answers? | No, not blindly. GF Everyday and any BYOK model can be wrong. For medical, legal, financial, or safety-critical decisions, consult a qualified human. |
| What happens if I break the rules? | Warning → temporary suspension → termination. Severe violations (CSAM, threats of violence) are immediate termination + reporting to authorities. |
| Can I cancel? | Any time. Settings → Account. No lock-in. |
| What if you change the terms? | Material changes (including changes to the §6.1 Free Covenant) get 30 days' notice by email. You can cancel or stop using the Service before they take effect. |
| What if you sell the company or one part of it? | We can assign these Terms to a successor (whole company, individual unit, or asset sale) with 30 days' notice. The successor decides whether to keep the Free Covenant — they aren't bound to. You'll have the notice window to export your data. See §19. |
| What if you shut something down? | We can discontinue the Service or any unit (.ai, .in, .live, .org) at our discretion. Planned wind-down: 30 days' notice + data export window + pro-rata refund of paid-tier fees. Free-tier users get the notice window but no refund. See §12.4. |
2. Who we are
All GabForge domains are operated by a single company, GABFORGE UNLIMITED (MSME Registration: UDYAM-TS-02-0101763), located at 142, Spanzilla, Gulam Ali Guda, Parvathapur Road, Medipally, Hyderabad 500098. The same company stands behind every GabForge product:
| Site | What it covers |
|---|---|
gabforge.ai, gabforge.live, gabforge.in |
The GabForge Everyday app and subsite hosting |
gabforge.org |
Open-source projects and the community forum (these Terms + the OSS addendum in §18) |
gabforge.com |
The company site (investor / press / careers) |
One account, one agreement. You use every GabForge product with a single GabForge account and sign in with GabForge OAuth — the "sign in with GabForge" button, just like signing in with Google. By creating that account or using the service, you accept these Terms with GABFORGE UNLIMITED. The same Terms apply across all GabForge products (with the product-specific sections below applying where relevant).
3. Eligibility
- You must be at least 18 years old. GabForge is not intended for minors (see Privacy_Policy §13).
- You must have the legal capacity to enter a binding contract in your country of residence.
- You must not be located in a country subject to comprehensive sanctions by India, the EU, the UK, or the US.
- If you are using the service on behalf of an organisation, you warrant that you have the authority to bind that organisation to these Terms.
4. Your account
- One account per person for free and Pro tiers. Family Caregiver tier covers up to two linked adult accounts (subscriber + dependent).
- You are responsible for the security of your credentials. Use a strong password and enable 2FA (Settings → Security). Any activity performed using your credentials is attributed to you until you report the compromise.
- You agree to provide accurate signup information and to update it when it changes (email in particular — we use it for critical notices).
- We may suspend or terminate accounts that violate these Terms, as described in §12.
5. What the service does
GabForge Everyday provides:
- AI assistance via a self-hosted model (GF Everyday v1) or via your Bring-Your-Own-Key (BYOK) provider.
- Personas — reusable AI configurations for different roles and tasks (23 defaults plus unlimited custom).
- Plugins and Boosters — extensions that add capability (e.g., "Remove Background," "GST Filing Assistant").
- A task queue + morning briefing for scheduled productivity flows.
- Subsite hosting on
gabforge.live— per plan (see §10). - Community and OSS participation on
gabforge.org.
Features evolve. We may add, remove, or change features with reasonable notice; we will not remove features that paying users specifically paid for without a refund or replacement (see §12.3, §12.4). Free-tier features are governed by §6.1 (Free Covenant) and may be modified, restricted, or discontinued under the conditions set out in that section together with §15 (Changes) and §19 (Assignment).
6. Pricing, payment, and BYOK
6.1 Free tier — the "Free stays Free" covenant
Scope. The Free tier is available with the quotas published at AI_Billing_Model §Free tier (currently ~30 GF Everyday messages per day plus unlimited plugin calls).
Our covenant. For as long as the Service is operated by GABFORGE UNLIMITED (the entity defined in §1), we commit to the Free stays Free covenant on the Free tier:
- No surprise paywalls — features available on the Free tier today will not be moved behind payment without at least 30 days' written notice per §15;
- No rationing prompts — we will not nag, throttle messaging, or degrade response quality to push you toward Pro;
- No advertising — we will not show third-party ads or sponsored content on the Free tier;
- No data-for-training trade — Free-tier users are not opted into model training in exchange for free access (see Privacy Policy §4).
Boundaries of this covenant. The Free Covenant is a present-tense commitment by GABFORGE UNLIMITED, not a perpetual licence and not a guarantee of indefinite continuance. Specifically:
- The covenant applies only while GABFORGE UNLIMITED operates the Service. It does not survive assignment of the Service (or any individual product line) to a successor entity under §19, and it does not survive discontinuation of the Service under §12.4.
- The covenant does not bind any successor, acquirer, or assignee of the Service unless the successor explicitly adopts it in writing in their own Terms of Service.
- The covenant may be amended like any other section of these Terms, under the notice and cancellation mechanism in §15.
- The covenant does not entitle Free-tier users to refunds, compensation, data-migration assistance, or service continuity in the event of amendment, assignment, or discontinuation. Free-tier users have not paid consideration; their remedy is to stop using the Service before the change takes effect.
See Free_vs_Premium_Philosophy for the strategic context, but in case of any conflict between that document and this section, this section governs.
6.2 Pro tier
- Paid subscription: ₹199/month in India, $9/month global (PPP-adjusted pricing for listed emerging markets — see pricing page).
- Billed monthly or annually. Renews automatically until cancelled. You can cancel any time; cancellation takes effect at the end of the current billing period. No partial refunds for mid-period cancellation except as required by law.
6.3 Family Caregiver
- ₹99/month. Covers one paying adult + one dependent adult account (typically adult child paying for retiree parent).
- Same cancellation terms as Pro.
6.4 Booster Packs
- One-time purchases, priced individually (typically ₹49–₹299).
- Each Booster grants the specific capability described in its marketplace listing, attached to your account for as long as the Service is operated by GABFORGE UNLIMITED and your account is in good standing.
- Wind-down and assignment treatment. A Booster is a one-time licence, not a perpetual right. On a wind-down of the Service or the relevant product line (§12.4), Booster refunds are governed by §12.3 (Booster purchases within 90 days of the wind-down notice: full refund; older Boosters: pro-rata where reasonably calculable, otherwise no refund). On assignment of the Service (§19), the successor entity decides whether to honour Boosters; if not, the same §12.3 refund mechanic is treated as the user's exclusive remedy.
- Refund terms are otherwise covered by the Refund & Cancellation Policy and the payment provider's dispute process.
6.5 BYOK (Bring Your Own Key)
- Free for as long as we operate the Service, no gate. (Like the §6.1 Free Covenant, BYOK passthrough is a present-tense commitment by GABFORGE UNLIMITED — it does not survive assignment to a successor that elects not to keep it under §19, or discontinuation of the Service or relevant product line under §12.4.)
- You supply an API key for a supported third-party provider (OpenAI, Anthropic, Google, Mistral, Groq, DeepSeek, xAI, Cohere, Together, OpenRouter).
- You pay the provider directly for the AI calls routed through your key. We do not see or intermediate that bill.
- You also accept that provider's terms for those API calls. Their terms cover data handling, rate limits, and model availability on their side; our ToS governs the orchestration layer and your experience inside GabForge.
- If your key is revoked, expires, or hits its quota, BYOK-routed features will fail gracefully with a prompt to rotate the key. Fallback to GF Everyday (if Pro) or the Free-tier quota (if Free) is controlled by your settings.
6.6 Taxes
- Prices are shown inclusive of GST for India buyers (18% GST applied to SaaS).
- Prices are shown exclusive of sales tax / VAT for US / EU / UK buyers; applicable tax is added at checkout.
- Invoices are issued via the payment processor (Razorpay).
6.7 Failed payments
- If a scheduled payment fails, we retry up to 3 times over 7 days.
- If all retries fail, the account is downgraded to Free tier. Paid features become unavailable; data is retained for 90 days to allow recovery.
7. Your content and licence
7.1 You own your content
Everything you put into the service — prompts, files, personas, custom instructions, subsite content, plugin configurations — remains yours. No transfer of ownership to us.
7.2 Licence to us (limited, for operating the service)
To run the service on your behalf, you grant us a worldwide, royalty-free, non-exclusive licence to host, copy, transmit, and display your content only:
- to you and the people you specifically authorise (e.g., subsite visitors, family-caregiver linked accounts);
- to the AI provider you route a request to (GF Everyday by default; BYOK provider if you've chosen one);
- to service providers (Hetzner, payment processors) strictly as needed to run the infrastructure.
This licence ends when you delete the content, or when your account is deleted — whichever is earlier.
7.3 What we will NOT do with your content
- We will not train AI models on your content unless you explicitly opt in, per-conversation, via the "donate this conversation" toggle (off by default; revocable).
- We will not sell, rent, or share your content with advertisers, data brokers, or any third party for their own purposes.
- We will not read your chats for product development, A/B testing, or telemetry. Aggregated, de-identified usage metrics (e.g., "how many personas does the median user create") are derived without human review of specific chats.
7.4 AI-generated output
Outputs from AI models (GF Everyday or BYOK) are generated in response to your prompts. To the extent we hold any rights in that output, we assign them to you (subject to third-party rights — e.g., the BYOK provider's own terms may differ, and no one can own a copyright over something that is not copyrightable).
You are responsible for ensuring that your use of AI output complies with applicable law and third-party rights (e.g., not passing off someone else's copyrighted text as your own prompt input).
8. AI output — important disclaimer
AI systems, including GF Everyday and every BYOK-supported model, can produce incorrect, incomplete, outdated, or misleading information. They can and do "hallucinate" facts.
You must not rely on AI output for:
- Medical diagnosis or treatment decisions — consult a qualified medical professional.
- Legal advice — consult a qualified lawyer in your jurisdiction.
- Financial or investment decisions — consult a registered financial adviser.
- Emergency or safety-critical situations — contact emergency services.
- Identity verification or authentication — use an established identity provider.
The service is a productivity tool, not a replacement for professional judgment. We provide the service "as is" and disclaim warranties to the maximum extent permitted by law (see §14).
9. Acceptable use
You may not use the service — and you may not use AI output generated via the service — to:
- Break the law in your jurisdiction, ours, or the user you're targeting's.
- Generate or distribute child sexual abuse material (CSAM). Zero tolerance. Reported to NCMEC, Indian authorities, and equivalent bodies wherever users are located.
- Generate non-consensual intimate imagery ("deepfakes") of real identifiable people.
- Harass, stalk, or threaten violence against a specific person.
- Generate content intended to defame, doxx, or impersonate a specific real person in a way designed to deceive.
- Plan, promote, or execute acts of terrorism, mass violence, or organised crime.
- Produce instructions for weapons of mass destruction (biological, chemical, nuclear, radiological) — even for "research."
- Conduct phishing, credential stuffing, malware development, or unauthorised network intrusion.
- Circumvent our rate limits, Tier boundaries, or security controls (e.g., scraping at scale from a free account).
- Use the service to operate a service that competes with GabForge itself — i.e., you cannot wrap our Free-tier API and resell it. (BYOK-passthrough for your own internal use is fine.)
- Misrepresent AI-generated output as human-authored in contexts where that misrepresentation causes harm (e.g., academic dishonesty, fraud, election interference).
See also the Subsite Guardrails (§10) for content hosted on gabforge.live.
Violations are investigated by our Trust & Safety team. Consequences range from content removal to immediate account termination and referral to authorities.
10. Subsites on gabforge.live
Pro subscribers can publish subsites on gabforge.live. Additional rules apply:
- You are the publisher of your subsite's content. We host it; we do not edit it. Under India's IT Rules 2021 §3(1)(d) and the US Section 230 framework, we act as an intermediary.
- You must comply with User_Subsite_Guardrails — no e-commerce, no user accounts on subsites, no payment collection, no content that violates §9 above.
- We will act on valid DMCA notices and equivalent takedown requests (India: IT Rules §3(1)(b); EU: DSA Art. 16) within 24–48 hours. Contact
[email protected]. - We reserve the right to suspend or remove a subsite for violations. We will provide written notice and a reasonable opportunity to cure (48–72 hours typical) except for illegal or emergency content, which is actioned immediately.
- Your subsite's traffic, analytics, and content remain yours; export is available via Settings → Subsites → Export.
11. Third-party services, BYOK, and plugins
- BYOK providers (OpenAI, Anthropic, Google, etc.) operate under their own terms. We are not party to that agreement; we do not warrant their service; their outages are not our breach.
- Plugins — first-party plugins are covered by this ToS. Third-party plugins (from our marketplace, when available) are governed by their own developer agreement; you should review any plugin's permissions before installing.
- Payment processor (Razorpay) — your use of its services is also governed by its terms. We are not a payment institution; we resell its checkout.
12. Suspension and termination
12.1 By you
- Cancel subscription: Settings → Account → Cancel Subscription. Takes effect at end of current billing period.
- Delete account: Settings → Account → Delete. 30-day grace window; then permanent deletion (see Privacy_Policy §8).
12.2 By us
We may suspend or terminate an account for:
- Violations of these Terms, especially §9 (Acceptable Use).
- Unpaid fees for paid tiers (after the failed-payment process in §6.7).
- Prolonged inactivity: accounts inactive for 24 months receive a reactivation notice; if no response, the account may be deleted 30 days later.
- Legal or regulatory obligation.
Non-emergency terminations come with advance written notice and an opportunity to export your data. Emergency terminations (CSAM, imminent-harm content, active abuse) are immediate and do not include a cure period.
12.3 Refunds on termination
- If we terminate you for violation, no refund of pre-paid fees.
- If we discontinue a feature or the whole service under §12.4, pro-rata refund of unused pre-paid Pro / Family Caregiver fees, computed to the wind-down effective date.
- Booster Packs purchased within 90 days of the wind-down notice: full refund. Older Boosters: pro-rata where reasonably calculable, otherwise no refund per the original purchase agreement.
- If you terminate mid-period for convenience, no partial refund (statutory minimums respected).
- Free-tier users are not entitled to any refund, credit, compensation, or migration assistance in any termination, suspension, amendment, assignment, or wind-down scenario. The Free tier is provided without consideration; the user's only remedy on adverse change is to discontinue use before the effective date.
12.4 Wind-down — discontinuation of the Service
We may discontinue the Service, or any individual product line (gabforge.ai, gabforge.in, gabforge.live, gabforge.org), in whole or in part, at our sole discretion. A wind-down may be voluntary (commercial decision, end-of-life) or involuntary (regulatory order, force majeure, insolvency).
For a planned (voluntary) wind-down, we will:
- Provide at least 30 days' notice by email to your registered account address and via in-app banner on the affected Service or product line;
- Open data-export functionality for the duration of the notice period (account export, plugin configuration export, subsite content export where applicable);
- Issue refunds to paid-tier users on the basis described in §12.3;
- Where commercially feasible and not contractually restricted by third-party licences, release useful artefacts (e.g., proprietary model weights, internal OSS components) under an open-source licence on
gabforge.org. This is a discretionary commitment, not a binding obligation.
For an involuntary wind-down (regulatory order, force majeure, insolvency, infrastructure-provider termination), notice and export windows may be shortened or, in extreme cases, omitted to the extent permitted by law. We will use reasonable efforts to preserve user data export for at least 7 days where the cause permits.
Partial wind-down. A wind-down of one product line (e.g., closing gabforge.live while keeping gabforge.ai running) triggers the obligations in this section only with respect to the discontinued unit. The remaining units continue under these Terms unchanged.
Release on wind-down. Upon the wind-down effective date, our obligations under these Terms with respect to the discontinued Service or product line terminate, except for liabilities accrued before that date and any statutory obligations that survive termination by law (e.g., data-deletion obligations under Privacy Policy §8, Indian DPDPA / EU GDPR rights).
No Free-tier remedy. Free-tier users have no claim, refund, credit, replacement service, migration right, or other remedy arising from a wind-down (voluntary or involuntary, full or partial). This is a material term of the Free tier; by using the Free tier the user accepts that the Free Covenant in §6.1 is contingent on continued operation by GABFORGE UNLIMITED and lapses on wind-down.
13. Intellectual property
- GabForge brand, logos, and the "GF Everyday" name remain our property. You may not use them to imply endorsement or create confusion.
- Our software and model weights: proprietary, licensed (not sold), governed by these Terms. OSS components are released under their declared licence at
gabforge.organd are subject to that licence, not this one. - Your feedback: if you send us suggestions, bug reports, or feature requests, you grant us a perpetual, royalty-free licence to use them without attribution or compensation. You retain any other rights you have in the feedback.
14. Warranties, disclaimers, and liability
14.1 Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUT.
Some jurisdictions do not allow certain disclaimers — those disclaimers do not apply to you to the extent prohibited, and your statutory consumer rights (India Consumer Protection Act 2019; EU consumer directives; UK Consumer Rights Act) are not limited by this section.
14.2 Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms or your use of the service is limited to the greater of:
- fees you paid us in the 12 months preceding the event giving rise to the claim, or
- ₹7,500 / $100 (whichever is higher in the currency of the billing relationship).
We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill.
Statutory consumer rights are not limited by this section. Nothing in this section excludes our liability for fraud, death, or personal injury caused by our negligence.
14.3 Indemnity (your side)
You agree to indemnify us against claims arising from:
- your breach of these Terms,
- your subsite content (for
gabforge.livepublishers), - your use of AI output in ways that cause third-party harm.
This indemnity does not apply to claims arising from our own breach or wilful misconduct.
15. Changes to these Terms
- Material changes (new obligations, fee increases, reduced rights, including amendment or removal of the §6.1 Free Covenant) get at least 30 days' email notice to your account email. You may cancel or stop using the Service before they take effect. Continued use after the effective date constitutes acceptance.
- Non-material changes (typos, clarifications, new contact addresses) are published with an updated "Last modified" date.
- Full revision history is maintained in the public CHANGELOG at the bottom of the published page.
- The amendment power in this section applies to every clause of these Terms equally. No clause is "entrenched" against amendment under our standard 30-day notice mechanism. The §6.1 Free Covenant is amendable on the same terms as any other clause — it is a present-tense commitment, not a perpetual right.
16. Governing law, jurisdiction, disputes
gabforge.ai / gabforge.live / gabforge.in — the app: Governed by the laws of India. Disputes: exclusive jurisdiction of courts in Hyderabad, Telangana, except where a user is a "consumer" under the Consumer Protection Act 2019 and may sue in their local district consumer forum. Small-claims-equivalent forums respected.
gabforge.org — open source: Governed by the laws of India (same). OSS contributor agreements are governed by the individual contribution's declared licence.
gabforge.com — company site: Governed by the laws of India. Commercial disputes may be arbitrated under the Arbitration and Conciliation Act 1996, seat Hyderabad, if both parties are commercial entities (not consumers).
International users: we comply with applicable local consumer-protection rules regardless of governing law. EU users may invoke the ODR platform (ec.europa.eu/consumers/odr) for online-sales disputes.
EU / UK consumer carve-out. For consumers residing in the European Union or the United Kingdom, any mandatory class-action waiver or mandatory consumer-arbitration clause contained in these Terms is void and unenforceable. EU consumers retain the right to collective redress under the Representative Actions Directive (EU 2020/1828). UK consumers retain the right to bring proceedings in their local courts under the Consumer Rights Act 2015. Nothing in this section limits mandatory consumer rights in the user's country of residence.
India consumer carve-out. Consumer disputes (as defined under the Consumer Protection Act 2019) are non-arbitrable in India under settled case law. Indian consumers may pursue claims in the District Consumer Disputes Redressal Commission in their jurisdiction notwithstanding anything else in this section.
17. India-specific provisions (for gabforge.in and Indian users of .ai / .live)
17.1 Intermediary due diligence (IT Rules 2021 §3(1))
We comply with the due-diligence obligations for intermediaries under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
- These Terms and the Privacy Policy are published and accessible to users.
- Users are informed at least once a year (by email + in-app notice) of the rules of use and of the consequences of non-compliance.
- Unlawful content is removed within the timeframes mandated by the Rules: 36 hours from receipt of a valid court order or government notice; 24 hours for non-consensual intimate imagery upon complaint.
- Interim Grievance Officer (T. V. Rao, Founder & CEO) is appointed and contactable per Email_Addresses §4 (
gabforge.in). The role is filled by the founder in the interim pending a dedicated hire. As an early-stage startup, a Nodal Contact Person is not statutorily mandated.
17.2 Grievance redressal
- Interim Grievance Officer: T. V. Rao (Founder & CEO), contact:
[email protected]. - Acknowledgement of grievance within 24 hours; resolution within 15 days (IT Rules §3(2); calendar days per statutory interpretation).
- Appeal route: Grievance Appellate Committee under Rule 3A.
17.3 Consumer rights
Nothing in these Terms limits rights you have as a "consumer" under the Consumer Protection Act 2019, including the right to approach the District Consumer Disputes Redressal Commission in your jurisdiction.
18. OSS addendum (applies only to gabforge.org)
- OSS project contributions are governed by the Developer Certificate of Origin (DCO) and the individual project's licence (typically MIT, Apache 2.0, or AGPL — check the repo
LICENSEfile). - Forum and community-forum posts are governed by a separate Code of Conduct, published at
gabforge.org/code-of-conduct. - Donations processed via
gabforge.orgfund OSS infrastructure and the free-tier shortfall (see AI_Billing_Model §Donations). Donations are not refundable except where required by law. - The open-source side does not sell paid subscriptions; Pro and Booster purchases are made on
gabforge.ai/gabforge.in, not.org.
19. Miscellaneous
- Severability — if any provision is held invalid, the rest remains in effect.
- No waiver — our failure to enforce a term is not a waiver of that term.
- Assignment — you may not assign these Terms or any rights or obligations under them. We may assign these Terms — in whole or in part — to a successor entity in connection with a merger, acquisition, sale of all or substantially all of our assets, sale of any individual product line (
.ai/.in/.live/.org/.com), corporate reorganisation, or spin-off, with at least 30 days' email notice to your registered account address. Upon the assignment effective date: (a) the successor entity assumes our obligations under these Terms going forward, in respect of the assigned scope; (b) the §6.1 Free Covenant does not automatically transfer to the successor — the successor may, at its sole discretion, adopt the covenant or replace it with its own commercial terms, subject to the successor's own §15-equivalent notice mechanism for any changes affecting existing users; (c) GABFORGE UNLIMITED is fully released from any obligation owed to users under these Terms with respect to the assigned scope, except for liabilities accrued before the effective date and any statutory obligations that survive assignment by operation of law (e.g., privacy / data-protection rights). Users who do not wish to continue under the successor's terms have, at minimum, the 30-day notice window to export their data and discontinue use. - Entire agreement — these Terms plus the Privacy Policy and any product-specific terms (e.g., plugin developer agreement) constitute the full agreement. Marketing materials and sales conversations do not override these Terms.
- Force majeure — neither party is liable for delays caused by events outside their reasonable control (natural disasters, internet outages, regulatory orders, pandemic disruption).
- Notices to us — by email to
legal@on the TLD operating your account; physical notices (where required) to the registered office (published once incorporated).
