Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products and services provided by GabForge AI ("GabForge", "we", "our", or "us"), including the GabForge AI coding API, GabForge Studio IDE, GabForge OS, GabForge Creative Suite, and all associated websites at gabforge.ai (collectively, the "Services"). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By creating an account, accessing the GabForge API at api.gabforge.ai, downloading GabForge Studio, installing GabForge OS, or otherwise using any of the Services, you confirm that you:

  • are at least 13 years of age (or the minimum legal age in your jurisdiction, whichever is higher);
  • have the legal capacity to enter into a binding contract;
  • agree to these Terms and our Privacy Policy; and
  • if acting on behalf of an organisation, have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Services. Continued use after any update to these Terms constitutes acceptance of the revised Terms.

2. Description of Services

GabForge AI provides the following products and services:

GabForge AI Coding API

An OpenAI-compatible REST API hosted at api.gabforge.ai that provides access to GabForge's fine-tuned coding models. The API accepts standard chat completion and code completion requests and returns AI-generated responses. Access is metered using a credits system (see Section 5).

GabForge Studio IDE

A free, open-source integrated development environment based on a VS Code fork with built-in multi-agent AI assistance. GabForge Studio supports both local model inference (via the built-in llama.cpp engine) and cloud API access. The IDE is released under the Apache 2.0 License.

GabForge OS

A custom Linux distribution based on Debian 13 Trixie with KDE Plasma, optimised for AI-assisted development workflows. GabForge OS is released as a free download and includes the GabForge Studio IDE and built-in AI inference engine pre-installed. The OS core packages are released under the Apache 2.0 License.

GabForge Creative Suite

A free, open-source all-in-one creative application covering raster editing, vector design, 3D modelling, video editing, audio production, and asset management. Released under the Apache 2.0 and MIT Licenses.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable. We will not be liable for any modification, suspension, or discontinuation.

3. Account Registration and Security

Registration

Access to paid features of the GabForge API and dashboard requires you to register an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Each account is for a single user or organisation; account sharing is prohibited unless explicitly authorised by a Business-tier plan.

API Keys

Upon registration you will be issued one or more API keys. These keys authenticate your requests to api.gabforge.ai. You are solely responsible for maintaining the confidentiality of your API keys. Do not embed API keys in client-side code, public repositories, or any other publicly accessible medium.

Security Responsibilities

You agree to:

  • use a strong, unique password and enable two-factor authentication where available;
  • notify us immediately at [email protected] upon discovering any unauthorised access to or use of your account; and
  • accept responsibility for all activity that occurs under your account, whether or not authorised by you.

GabForge will never ask for your password by email. If you receive such a request, treat it as fraudulent and report it to us.

4. Acceptable Use Policy

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services to:

Prohibited Content and Activities

  • generate, distribute, or facilitate content that is illegal, defamatory, obscene, or violates any applicable law or regulation;
  • produce malware, exploit code, phishing material, spam, or other malicious software;
  • infringe on the intellectual property, privacy, or other legal rights of any person or entity;
  • generate content that sexually exploits minors;
  • produce disinformation, deepfakes, or synthetic media designed to deceive;
  • facilitate illegal surveillance, stalking, or harassment of individuals; or
  • assist in the development, production, or deployment of weapons, including biological, chemical, nuclear, or radiological weapons.

Platform Abuse

  • attempt to circumvent, disable, or interfere with security features of the Services;
  • reverse-engineer, decompile, or extract our proprietary GabForge-Coder model weights or any non-open- source components of the Services;
  • use automated scripts or bots to scrape, crawl, or extract data from our websites beyond normal API usage;
  • attempt to exceed rate limits or otherwise circumvent credit-usage controls; or
  • resell, sublicense, or provide API access to third parties without entering into a separate reseller agreement with GabForge.

Enforcement

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund. We may report violations to relevant law enforcement authorities where required by law or where we determine it is necessary to protect the safety of individuals.

5. API Usage and Credits

Credits System

API access is metered using GabForge Credits. Each request to api.gabforge.ai consumes credits based on the model used and the token count of the request and response. Your current credit balance and consumption history are visible in your dashboard at gabforge.ai/dashboard/.

Subscription Credit Allowances

  • Free tier: 100 credits per calendar month. Credits do not roll over.
  • Developer ($9/mo): Credits as specified on the Pricing page. Unused credits do not roll over.
  • Pro ($29/mo): Credits as specified on the Pricing page. Unused credits do not roll over.
  • Business ($99/mo): Credits as specified on the Pricing page with team-pooling support. Unused credits do not roll over.

Top-up credit packs are available for purchase separately at any time. Purchased top-up credits are valid for 12 months from the date of purchase and carry over across billing cycles until expiry.

Rate Limits

All tiers are subject to per-minute and per-day rate limits as published on the Pricing page and in the API documentation at gabforge.ai/docs/. Rate limits exist to ensure equitable access for all users. We reserve the right to adjust rate limits with reasonable notice. Sustained attempts to exceed rate limits may result in temporary or permanent suspension of API access.

Bring Your Own Key (BYOK)

GabForge Studio IDE and GabForge OS support BYOK, allowing you to supply your own API keys for third-party AI providers (for example, OpenAI, Anthropic, or Google). When you use BYOK, your requests are routed directly between your machine and the third-party provider; they do not pass through GabForge servers and do not consume GabForge Credits. GabForge is not responsible for the availability, pricing, or terms of any third-party provider.

Fair Use

We operate under a fair-use policy. Any usage pattern that, in our reasonable judgement, constitutes excessive automated consumption disproportionate to normal developer workflows may be throttled or reviewed. We will attempt to contact you before taking action on fair-use grounds.

6. Payment and Billing

Subscription Plans

Paid subscriptions (Developer, Pro, Business) are billed monthly or annually as chosen at checkout. All prices are displayed on the Pricing page. Prices are exclusive of applicable taxes unless stated otherwise. You authorise GabForge to charge your payment method on a recurring basis at the start of each billing period.

Payment Methods

We accept payment via Stripe, PayPal, and Razorpay (for India-based customers). By providing payment information you confirm that you are authorised to use the payment method and you authorise us to charge it for your subscription and any additional purchases. Payment is processed by our payment processors; GabForge does not store raw card numbers on its servers.

Refund Policy

New subscribers may request a full refund within 7 calendar days of their first payment for that subscription tier by contacting [email protected]. After this period, subscription fees are non-refundable except where required by applicable law. Credit top-up packs are non-refundable once any credits from the pack have been consumed. If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate promptly.

Upgrades, Downgrades, and Cancellation

You may upgrade your plan at any time; the difference in cost is prorated for the remainder of the billing period. Downgrades take effect at the end of the current billing period. You may cancel your subscription at any time through your dashboard. Upon cancellation, your paid benefits remain active until the end of the paid period; no partial-month refunds are issued.

Taxes

You are responsible for any applicable taxes, levies, or duties imposed by governmental authorities on your purchases, including goods and services tax (GST) for Indian customers. Where required, GabForge will collect and remit GST in accordance with Indian tax law.

7. Intellectual Property

GabForge Platform

The GabForge AI platform, including the proprietary GabForge-Coder model weights, the API infrastructure, the website, and all associated non-open-source software and content, is owned by GabForge AI and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of GabForge's proprietary technology to you.

Your Code and Content

You retain full ownership of all source code, prompts, and other content you submit to the Services ("Your Content"). By submitting Your Content to the cloud API, you grant GabForge a limited, non-exclusive, royalty-free licence to process Your Content solely for the purpose of providing the requested API response. This licence is ephemeral: it exists only for the duration of the request. We do not claim any ownership of Your Content and do not use it to train models (see Section 9).

AI-Generated Output

Code, text, or other output generated by the GabForge API in response to your prompts ("Output") is provided to you for your use. To the extent permitted by applicable law, GabForge assigns any copyright in the Output to you. You are responsible for evaluating the Output for accuracy, legality, and fitness for your purpose before using it in production.

Feedback

If you submit suggestions, bug reports, or other feedback about the Services, you grant GabForge a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the Services, without any obligation to compensate you.

8. Open-Source Components

GabForge believes in open-source software as a foundational principle. The following products are released under open-source licences and governed by the terms of those licences:

  • GabForge Studio IDE — Apache License 2.0. Source available at github.com/gabforge/studio.
  • GabForge OS — Core system packages and tooling under Apache License 2.0; underlying Linux kernel and Debian packages under their respective licences (primarily GPL-2.0). Source available at github.com/gabforge/os.
  • GabForge Creative Suite — Apache License 2.0 and MIT License. Source available at github.com/gabforge/creative-suite.

Your use of the open-source products is governed by the applicable open-source licence, not these Terms of Service. These Terms apply only to the hosted cloud services, the GabForge API, and your account on gabforge.ai. A copy of the Apache License 2.0 is available at apache.org/licenses/LICENSE-2.0.

Third-party open-source libraries incorporated into the Services are used in compliance with their respective licences. Attribution notices and licence texts are included in the source repositories and in the NOTICES files distributed with each product.

9. Privacy and Data

Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully to understand how we collect, use, and protect your information.

Local-First Principle

When you use GabForge Studio IDE or GabForge OS with local AI models (powered by the built-in llama.cpp inference engine), your code and prompts never leave your machine. No data is transmitted to GabForge servers during local inference. We do not collect telemetry on your codebase or local AI interactions unless you explicitly opt in to optional diagnostic reporting.

Cloud API Processing

When you send requests to api.gabforge.ai, your prompts are transmitted over TLS and processed ephemerally on our servers to generate a response. We do not store, log, review, or use your prompts or the generated responses for model training. Request metadata (timestamp, token count, model used, and credit cost) is retained for billing and audit purposes for 90 days, after which it is deleted.

No Training on Your Data

GabForge does not use Your Content to train, fine-tune, or evaluate any AI model. This applies to both cloud API requests and any optional telemetry. Our models are trained exclusively on public datasets and licensed data.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GABFORGE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-generated output is probabilistic and may contain errors, inaccuracies, or content that is out of date. You are solely responsible for reviewing and validating any Output before relying on it or incorporating it into your projects. GabForge makes no representations regarding the accuracy, reliability, or completeness of any Output.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GABFORGE AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GABFORGE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

12. Termination

Termination by You

You may terminate your account at any time by deleting it from your dashboard or by contacting [email protected]. Upon termination you will lose access to the Services and any remaining credits (except where a refund is due under Section 6). Your account data will be deleted in accordance with our Privacy Policy.

Termination by GabForge

We may suspend or terminate your access to the Services at our discretion, with or without notice, if:

  • you breach these Terms or our Acceptable Use Policy;
  • your account is used for fraudulent or illegal activity;
  • your payment fails and is not resolved within 14 days of notice; or
  • we are required to do so by law or court order.

In the event of termination for cause, no refund will be issued. In the event of termination by GabForge for reasons other than cause (for example, discontinuation of a product), we will provide at least 30 days notice and a prorated refund of any prepaid fees for the unused period.

Survival

Sections 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Termination), and 13 (Governing Law) survive any termination or expiry of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms or the Services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Before initiating formal legal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for a period of 30 days. This informal resolution requirement does not apply to intellectual property claims or requests for emergency injunctive relief.

Nothing in this section limits the rights you may have under applicable consumer protection legislation in your jurisdiction.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your account) or by displaying a prominent notice on gabforge.ai at least 14 days before the changes take effect. The updated Terms will be posted at gabforge.ai/terms/ with a revised "Last updated" date. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Services and may cancel your account.
