Privacy Complaint Service: Who Qualifies and What You Get

Learn how to access investigations and mediation if you believe your privacy has been breached in New Zealand.

The Privacy Complaint Service allows you to take action if you believe your personal information has been handled incorrectly or your privacy has been breached.

Who it's for

This service is available to anyone who believes their privacy has been breached. If you feel that an organization or individual has mishandled your personal data or violated your privacy rights, you may be eligible to use this service to seek a resolution.

What you get

The service provides two main ways to resolve your issue. First, they can conduct an investigation to look into the circumstances of the breach to understand what occurred. Second, they offer mediation services, which is a process designed to help you and the other party reach a mutual agreement regarding the situation.

What it costs you

Using this service is free. There are no fees required to lodge a complaint or to engage with the mediation and investigation processes provided by the Office of the Privacy Commissioner.

The catch to know

It is important to understand the limits of this service before you begin. While the service can facilitate mediation to help parties reach a settlement, they do not have the legal authority to force a payout or compel an organization to pay you a specific amount of money.

How to apply

  1. Gather all relevant information regarding the specific privacy breach you are concerned about.
  2. Attempt to contact the organization or individual involved to try and resolve the issue directly.
  3. If you cannot reach a resolution on your own, prepare your documentation and details regarding the breach.
  4. Submit your formal complaint through the official channels provided by the Office of the Privacy Commissioner.
