Public Holidays Act: Who Qualifies and What You Get
Learn your rights regarding paid time off and extra pay when working on public holidays in New Zealand.
The Public Holidays Act sets out the rules for how employees should be treated when a public holiday occurs.
Who it's for
This applies to all employees.
What you get
If a public holiday occurs, you are generally entitled to a paid day off. If you are required to work on a public holiday, you should receive time-and-a-half pay plus a day in lieu (a different day off with pay) to make up for the holiday worked.
What it costs you
It costs you nothing. This is a statutory right provided by law.
The catch to know
You only receive a day in lieu if the public holiday falls on a day you would normally be expected to work. If a public holiday falls on a day that is not part of your regular work schedule, you do not get a compensatory day off.
How to apply
- Review your employment agreement to see your regular working days.
- Check the official calendar for upcoming public holidays.
- Speak with your employer if you are asked to work on a public holiday to confirm your pay and time in lieu.
